Terms of Use
These Pokecazilla Terms of Use (hereinafter referred to as "these Terms") define the conditions for using the Pokecazilla service (hereinafter referred to as "the Service") and the rights and obligations between Kabuki Inc. (hereinafter referred to as "the Company") and the users regarding the Service. These Terms apply to all relationships related to the use of the Service between the users and the Company.
These Terms apply to activities such as Wiki editing, posting comments, card evaluations, etc.
The following terms used in these Terms shall have the meanings ascribed to them as follows:
1. Pokecazilla Terms of Use - Refers to this agreement, and the service usage agreement concluded between the Company and the user.
2. Company - Refers to Kabuki Inc.
3. Website - Refers to the website "Pokecazilla."
4. Service - Refers to all information provided through the Website.
5. Membership Service - Refers to the part of the Service that is available only to registered members.
6. Prospective Member - Refers to individuals who wish to receive membership services.
7. Membership Registration - Refers to the process by which a Prospective Member agrees to these Terms and applies for the provision of membership services as defined by the Company.
8. Member - Refers to individuals who have expressed the desire to receive the Service, have agreed to these Terms, and have completed the membership registration process, which has been approved by the Company.
9. User - Refers to all individuals who use the Service provided by the Company, including Members.
10. Registration Information - Refers to all information disclosed to the Company by the Member in relation to membership registration and the use of the Service.
11. Personal Information - Refers to all information within the Registration Information that can identify a specific individual, such as an email address.
12. Authentication Information - Refers to the information within the Registration Information that is necessary for the Company to authenticate a connection from a Member, such as an ID and password.
13. Withdrawal - Refers to the cancellation of membership registration and the termination of the provision of membership services in accordance with these Terms and the method prescribed by the Company.
1. The purpose of the Service is to provide a platform for the exchange of information related to the Pokémon Trading Card Game through a question-and-answer format among members, the viewing of information provided on the website, opportunities for users to collect and view such information, as well as providing an environment for these activities.
2. The Company may, when necessary, add new services to the Service or modify the contents of the Service. Members agree in advance to these changes and use the Service accordingly.
Users shall use the Service in accordance with these Terms.
By using the Service, users are deemed to have agreed to these Terms.
The Company reserves the right to revise these Terms at its discretion within a reasonable scope.
In the event of changes to these Terms, the revised Terms shall apply after notification of the changes, and if users continue to use the Service after the changes, they are deemed to have agreed to the revised Terms.
1. A prospective member, after agreeing to these Terms, must personally complete the membership registration process in accordance with the method prescribed by the Company.
2. Upon receiving a membership registration request as outlined in the previous clause, the Company will determine whether or not to approve the registration after undergoing necessary screening and procedures as prescribed by the Company. The Company reserves the right to deny registration without disclosing the reason to the prospective member.
3. If the Company approves the membership application, a membership service usage agreement, based on these Terms, will be established between the Company and the prospective member.
4. Members are deemed to have agreed to receive membership services once the Company approves their membership.
5. Members cannot transfer, lend, provide as collateral, or otherwise allow third-party use of their rights to receive membership services.
6. Members are responsible for managing their authentication information at their own cost and cannot transfer or lend such information to third parties.
7. Any statements made to the Company using the authentication information will be regarded as statements made by the member themselves. In the event that the authentication information is fraudulently used and causes damage to the Company, the member shall be responsible for compensating the Company for such damages.

1. If a member wishes to withdraw from the Service, they must personally complete the withdrawal procedure. Withdrawal will be effective upon completion of the designated procedure.
2. If the Company deems that a user has violated or is likely to violate these Terms, it may suspend or terminate the user’s account or restrict the use of the Service (including limiting the user\'s status or authority on the Service) without prior notice to the user.
1. The Company shall not be liable for any damages incurred by the user due to the addition, modification, suspension, or termination of the Service.
2. The Company assumes no responsibility for any transactions between members and third parties, including affiliated companies, made through the Service. All transactions are the sole responsibility of the member and the third party involved.
3. The Company shall not be liable for any data corruption or other damage caused by external factors affecting the Service.
4. The Company is not responsible for any damage to computers, communication lines, software, or any other equipment caused by downloads or computer virus infections originating from the Service or third-party websites, including those of affiliated companies.
5. Users guarantee that any content, such as Wiki entries, posted on the Service does not violate laws or infringe on the rights of any third party.
6. The Company reserves the right to suspend or terminate all or part of the Service without prior notice. In such cases, the Company assumes no liability to the user.
Users are prohibited from engaging in any of the actions listed below while using the Service and guarantee not to perform the following actions. If a member engages in any of the following actions, the Company may immediately take measures such as suspending the use of the Service or deleting the content posted by the member.
1. Acts that violate laws, court rulings, decisions or orders, or legally binding administrative measures.
2. Acts that infringe or may infringe on the property, privacy, image rights, or other rights of the Company, other users, or third parties (hereinafter referred to as "others").
3. Acts that infringe or may infringe on the intellectual property rights, such as copyrights or trademark rights, of the Company or others.
4. Acts that disrupt public order or morals (including posting, publishing, sending excessively violent expressions, explicit sexual content, or other antisocial content that makes others uncomfortable).
5. Acts of impersonating the Company or others, or deliberately spreading false information.
6. Collecting, disclosing, or providing personal information, registration information, or usage history of others without their permission.
7. Using the Service for commercial purposes without prior consent from the Company, engaging in activities primarily for the purpose of seeking encounters or relationships with the opposite sex, or using the Service for purposes other than those intended by the Company.
8. Acts that interfere with the operation of the Service by the Company or with the use of the Service by other users.
9. Providing benefits to or otherwise cooperating with antisocial forces.
10. Engaging in religious activities or soliciting for religious organizations.
11. Acts of discrimination or defamation against others, or acts that damage the honor or credibility of others.
12. Acts that are deemed to be aimed at excessively or inappropriately directing users to specific external websites.
13. Pre-election campaigning, election campaigning (including similar activities), or acts that violate the Public Offices Election Act.
14. Acts of distributing information, devices, software, etc. intended to disable or circumvent server access control functions.
15. Acts of duplicating, modifying, reproducing, altering, changing, reverse engineering, disassembling, decompiling, translating, or analyzing the functions provided by the Service.
16. Acts of linking to data or content that falls under any of the prohibited actions listed above (including when such actions are carried out by others) for the purpose of promoting these actions.
17. Any other acts that the Company deems inappropriate for users.
1. All intellectual property rights related to the Service belong to the Company or to those who have granted licenses to the Company. The permission to use the Service under these Terms does not imply the granting of any intellectual property rights related to the Service by the Company or its licensors.
2. Users represent and warrant to the Company that they have the legal rights to post or otherwise transmit the data they submit (hereinafter referred to as "Posted Data") and that the Posted Data does not infringe on the rights of third parties.
3. Users grant the Company a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, create derivative works of, display, and perform the Posted Data. Additionally, users grant other registered users a non-exclusive license to use, reproduce, distribute, create derivative works of, display, and perform the Posted Data that the users have posted or otherwise transmitted through the Service.
4. Users agree not to exercise their moral rights of authorship against the Company or those who have succeeded or been granted rights by the Company.
1. These Terms shall be interpreted in accordance with the laws of Japan.
2. In the event of any doubts or disputes arising between users, the Company, or third parties in connection with the Service, the parties shall strive to resolve the matter through sincere discussions.
3. If the doubts or disputes cannot be resolved through the discussions mentioned in the previous clause, the Tokyo District Court or the Tokyo Summary Court shall have exclusive jurisdiction as the court of first instance.
